Urgent Call to Action: Re - US Govt Ban on Sale of Minibikes

Yesterday, a law went into effect prohibiting the sale of minicycles to children under the age of 13 as a result of the lead content in the machines (Consumer Product Safety Improvement Act of 2008, Title I, Section 101). This law, which arguably applies to both motorcycles and ATVs, treats any children's product that contains more lead than the limit established by law as a banned hazardous substance.

We have already begun to experience the devastating consequences of this new legislation upon our sport, as OEMs have already pulled these machines from their showroom floors. Youth racing is the foundation of our sport. That is when most of you fell in love with motorcycles in the first place, only to grow up to bring your own kids back to the racetracks. Only now, they can't ride.

On behalf of MX Sports (Loretta Lynn's), Racer Productions (GNCC), and ATVPG (ATV Amateur Nationals), we are extremely concerned with the short- and long-range effects of this new legislation, as the first rounds in all of our various series are less than two weeks away, and all include classes for youth racers under the age of 13. But it's not just our events - WORCS, NMA, Mini Os, SETRA, etc., are all adversely impacted.

It is our opinion that the new law is inapplicable to off-highway motorsports, as neither motorcycles nor ATVs have the potential for ingestion, and lead from motorcycles is not likely to be absorbed into the bloodstream or present a health hazard. Let's face it - when was the last time someone swallowed a motorcycle? Any other interpretation would be silly. Be that as it may, the law will continue to adversely affect our industry unless and until an exemption is granted.

Presently, there is a petition for an immediate temporary exemption pending before the Consumer Product Safety Commission ("CPSC") filed by the Motorcycle Industry Council (MIC) on behalf of the OEMs, distributors, and industry associations. This petition, if granted, would enable our industry to move forward this racing season while the applicability of the law to the off-highway industry is determined.

What can you do?

A form letter for submission to the CPSC in support of the petition for exemption is attached as prepared by the MIC. The letter will also be available this weekend at the Indy tradeshow. Simply print out one copy for each person in your family and submit it ASAP. In the meantime, AMA is preparing a letter for submission by its membership to the CPSC. Be on the lookout for that one as well.

Also, an electronic form letter has been prepared by State Representative Tom Self of Missouri. Please go his website at www.tomself.com. Just fill in your name and address and hit "Submit" to register your support. Please submit this letter on behalf of every member of your family - regardless of age.

What else can you do?

Contact your congressmen and senators; let them know that this legislation will have the unintended consequences of crippling an entire industry. Surely, it could not have been the spirit or intent of the new law to apply to motorcycles or bicycles (which apparently have lead in the brake cables).

Time is of the essence. The very future of our sport and of our industry depends on this. We must support the pending petition before the commencement of the national racing season.

Please give this matter your immediate attention, and forward this letter to EVERY PERSON available ASAP.

More Govt bull shitt ..........Soon we will be asked or ordered to turn on our Motorcyles because we may get hurt riding them ...Is this all our Govt has time to do is make up stupid laws ?

Socialism allows for the government to tell us what is good and bad for our children, but remember America voted for "change we can believe in" and we haven't even seen the beginning of new federal laws.

I've supported the AMA most of my life, but after watching whats going on these days I may not renew. Just an improperly mounted tag in FL is over a $1000 fine with the new laws here.

Other states and municipalities are passing crazy laws, axing bike weeks, closing lands, tightening fuel emissions to the point half the bike is exhaust system and a heat monstor, etc etc etc

I guess the AMA is sleeping, and we're on our own to submit petitions, cry to politicians and such.

I'm trying to figure what incentive it was for me to renew last time

Lead poisoning is only a danger if the lead is eaten or if lead dust or the fumes from molten or very hot lead are inhaled. The fear of lead poisoning is vastly exagerated. Contact between the skin and lead isn't a hazard as long as the skin is washed to avoid accidental ingestion.

Lead paint has been banned in the US for many years. Now we have Zinc and Titaneum pigments that are probabley every bit as good (only time will tell if they are as durable). I imagine motorsports will find a good substitute as well. But hell no, lets not take our kids bikes away.

fuckin ridiculous. Porkbarreling based upon foolish pretenses is the name of the game. Government will continue to push BS upon us, and we will soon experience a slow transition into a socialistic federal government. I live in california, regretfully, and have the utmost contempt for our elected officials. They have no touch of reality, and instead of doing actual good to the community, they create "cant do" laws. They are all trying to remove individualism from our society, and create large, controlling government. Get ready and buy your guns, as you may have to point them at the government yet again, as history shows. The time of governmental waste, mismanagement, and lack of any accountability is in dire need to end. Democrats are playing a completely different sport, republicans are living in the conservative side of the 60's, and the other political organizations are simply a joke. I am independent, and voted for McCain. He is a hero, Obama is a zero. Never ran anything, and has no comprehension of American Values. He is on a personal crusade for blacks and most importantly, is parading the democratic party as the "Change" party.

The names change, but the bullshit thats out of control never does,

The citizens of the USA need to take control over their socialist/ communist government.
Slowely and obscurely they will take all your rights and your paychecks away....

that is what socialist governments do.....

Our Canadian government isn't much different, and i would be very surprised if they didn't follow suit like the puppets they are...

It maybe time to have the law makers checked for addiction to crack becuase laws like that are just BS.
Any law that gives a kid another excuse to remain stationary in from of the TV is detrimental to their future.

People can't even bring the samll bikes into get serviced or repaired. You have issue's with your kids 110......the shop can no longer order parts.

As previously mentioned if you live in Ontario your kids will not even get to ride on the back of your bike as soon as the Liberals get threw with you.
